Terms and Conditions

1. Agreement and operator
These Terms and Conditions govern your use of OllieTrail, operated by
AvantiPoint, LLC. By creating an account or using the service, you
agree to these terms. If you do not agree, do not use OllieTrail. Our
Privacy Policy explains how we handle
information.
2. Eligibility and household accounts
The account holder must be at least 18 years old, legally able to
enter this agreement, and the parent, legal guardian, or otherwise
legally authorized adult for any child profile they manage. You are
responsible for obtaining any required permissions before providing a
child’s information. Children use OllieTrail under adult supervision.
Keep your sign-in and parent PIN secure and provide accurate account
information. Do not impersonate another person or access a household
without permission.
3. Co-parents
You may link another adult account through the household-linking flow.
Linking grants that person access to shared household information and
child management. You are responsible for linking only an authorized
adult. Each adult must use their own sign-in. Use parent controls or
contact us to address access disputes or remove access; we do not
determine custody or guardianship disputes.
4. Educational use and AI
OllieTrail provides practice, coaching, and learning support. Ollie is
an AI system, not a human teacher. Generated questions, explanations,
assessments, translations, and speech feedback may be incomplete or
wrong. We do not guarantee grades, proficiency, learning outcomes, or
suitability for a particular curriculum. The service does not provide
medical diagnoses, special-education determinations, or accredited
academic qualifications. Parents should supervise use, consider the
child’s needs, and report inappropriate or incorrect content.
5. Permission to use the service
We grant you a limited, non-exclusive, non-transferable right to use
OllieTrail for your household’s personal educational purposes while
you comply with these terms. Our branding, software, interface, and
original educational materials remain owned by AvantiPoint or its
licensors. You may save or print learning materials for personal
educational use, subject to any rights belonging to others.
6. Your content
You retain the rights you have in the messages, recordings, drawings,
and other material you provide. You grant us permission to process,
store, reproduce, and share that material with the service providers
and authorized household members necessary to operate, secure,
support, and personalize OllieTrail, as described in the Privacy
Policy. This permission does not authorize us to sell your child’s
content or use it in advertising. Submit only material you have the
right to share. AI outputs may resemble outputs provided to other
users and may not be unique or eligible for intellectual-property
protection.
7. Acceptable use
Do not use the service for unlawful activity, harassment,
exploitation, or harmful content; upload malware; bypass account
protections, usage limits, or access controls; attempt to access
another family’s information; interfere with the service; or use
automated collection, resale, or commercial redistribution without
permission. Report security issues through our contact page rather
than testing against other users’ information.
8. Subscriptions, renewal, and cancellation
Starter costs $100 USD per month per child and includes 8 hours of AI
tutor time per paid billing period. Explorer costs $200 USD per month
per child and includes 20 hours. Each plan also includes one separate
hour of parent AI conversations per child, shared by the household's
parents. Allowances reset at the monthly billing renewal, not at the
beginning of the calendar month. Unused time expires without rollover.
Voice time includes the connected conversation. Text and recorded
answers use a rolling one-minute interaction window, extended when
another AI interaction occurs; simultaneous model or tool calls in
that window are counted once. Reading and saved activities without AI
do not use tutor time. New AI interactions pause when the allowance is
exhausted; saved learning records remain accessible. Discounts affect
the price paid, not the plan's included time. Each
child has a separate subscription. Payment is required before AI use,
including the parent onboarding interview. Stripe processes your
payment securely. By purchasing, you authorize recurring monthly
charges at the price shown at checkout until you cancel. Any
applicable taxes or additional charges will be shown before you
confirm your purchase. There is no free trial unless expressly offered
at checkout.
Plan changes selected in Parent mode take effect for tutoring access
and recurring charges at your next renewal. There is no mid-period
proration or reset of used time. The current paid allowance remains
unchanged until the next cycle is paid. Stripe displays the upcoming
charge before you confirm; applicable discounts and taxes may affect it.
Manage payment methods, invoices, and cancellations in Parent mode
under Subscriptions → Manage billing. Cancellation takes effect at the
end of the paid billing period; access continues until then. Failed or
overdue payments may suspend AI access until resolved. Deleting a
profile does not automatically cancel a subscription; cancel it before
deleting the profile. Learning-record resets do not cancel
subscriptions.
Payments are generally nonrefundable for unused time except where
required by law or expressly agreed by AvantiPoint, LLC. Contact us at

about duplicate charges, billing errors, or refund requests. We will
give notice of material price changes before they apply to a renewal.
Signing in alone does not authorize a charge. Stripe sandbox payments
are test transactions and do not charge real money. AI usage figures
shown in the app are estimates of provider costs, not additional
invoices to you.
9. Availability and termination
We may change, limit, suspend, or discontinue features, including
preview features, and may suspend access for misuse, security
concerns, legal requirements, or failure to comply with these terms.
We will give reasonable notice when practicable. You may stop using
the service at any time and request deletion as described in the
Privacy Policy. Provisions that by their nature should survive
termination, including ownership, disclaimers, and liability limits,
continue to apply.
10. Third-party services
The service relies on providers including Cloudflare, OpenAI, Google,
and Microsoft. Their availability and policies can affect features.
Third-party sites linked from OllieTrail are operated independently.
We are not responsible for their content or services, except to the
extent required by law.
11. Disclaimers and limits of liability
To the extent permitted by law, OllieTrail is provided “as is” and “as
available,” without warranties of uninterrupted operation, accuracy,
fitness for a particular purpose, merchantability, or
non-infringement. To the extent permitted by law, AvantiPoint and its
suppliers are not liable for indirect, incidental, special,
consequential, or punitive damages, or loss of profits, arising from
use of the service. Our total liability for claims arising from the
service is limited to the greater of US $100 or the amount you paid us
for OllieTrail in the 12 months before the event giving rise to the
claim. These limitations do not exclude liability for fraud,
intentional misconduct, or any liability or consumer rights that
cannot legally be excluded or limited.
12. Disputes and general terms
Please contact us first so we can try to resolve a concern. Except
where mandatory local law provides otherwise, Wyoming law governs
these terms without regard to conflict-of-law rules, and disputes may
be brought in the state or federal courts serving Wyoming. Nothing in
these terms removes protections or court access you have under
mandatory consumer law. If a provision is unenforceable, the remaining
provisions remain effective. Failure to enforce a provision is not a
waiver. You may not transfer your account or this agreement without
our permission; we may transfer the service and related obligations as
part of a lawful business transfer.
13. Updates and contact
We may update these terms and will identify the current version by its
effective date. We will provide notice of material changes and obtain
agreement where required by law. Continued use after an update takes
effect is subject to the updated terms, except where additional
